Supreme Court rejects case on dismissal of Presidential appointees

Supreme Court (SC) has rejected the law suit filed by three former Presidential appointees of former President Gayoom to the People’s Majlis claiming that the dismissal of the 8 appointees of President Gayoom to the Majlis and the appointment of new appointees by the newly installed President Mohamed Nasheed is unconstitutional and thus illegal.

Chief Justice Abdulla Saeed yesterday expressed that under the Transitional Chapter of the new constitution the case should be submitted to Civil Court and not to Supreme Court and as the matter has been rejected yesterday.

President Mohamed Nasheed after his inauguration on 11 November 2008 has appointed 8 new Presidential appointees to the People’s Majlis. They are former Dh member of the People's Special Majlis Mohamed Riyaz, former H Dh member of the People's Special Majlis Ahmed Adil, former H A member of the People's Special Majlis Ahmed Sameer, popular football player Ahmed Haleem Dhonbileiy, President of MDP HA Branch Ahmed Abdullah, S. Hulhudhoo Dhethadimaage Ibrahim Hameed, Member of the MDP National Council Mohamed Rasheed Hussain and former GA Special Majlis member Adnan Haleem.

Dhivehi Rayithunge Party, shortly after President Nasheed announced his appointments to the Majlis has criticized his move calling it unconstitutional. At a new conference DRP claimed that the former presidential appointees cannot be dismissed under Transitional Chapter of the current constitution and that the constitution does not give any power to dismiss or appoint any member to the People’s Majlis.

DRP Attorney Dheena Hussain speaking at the news conference has said that President Nasheed cannot dismiss the former President’s appointees as he does not have the power to do so. She said she will press charges with the Supreme Court and will seek a ruling. The case was file by three of the former presidential appointees, Lubna Mohamed Zahir Hussain, Ahmed Mahloof and Abdul Rasheed Nafiz.

With the dismissal of the former appointees, some 30 to 40 people gathered in front of Majlis House and staged a protest shouting that the dismissal of former President Gayoom’s members from the Majlis was unconstitutional. Speaking at the Majlis Session held that day Ga member Abdulla Jabir had expressed that the Majlis was in violation of the constitution.

Special Envoy of the President Ibrahim H Zaki speaking to press earlier said that appointees of the president’s have to be people the president can trust and that it should not misunderstood by anybody.

The matter is now expected to be submitted to Civil Court. But Miadhu Daily’s attempts to contact any of the 3 former appointees who pressed charges were unsuccessful.
